By accessing or using AmberProof ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
AmberProof is a web archiving service that allows users to capture, preserve, and compare web pages for legal and evidentiary purposes. The Service provides:
- Web page screenshot capture
- HTML content preservation
- Cryptographic integrity verification
- Visual comparison tools
- Export functionality for legal use
3. User Accounts
3.1 Registration
To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.
3.2 Account Security
You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree to use the Service only for lawful purposes. You may not:
- Capture content you do not have the right to access or preserve
- Use the Service to infringe on intellectual property rights
- Capture content for harassment, stalking, or other malicious purposes
- Attempt to circumvent security measures or access controls
- Use automated tools to excessively burden the Service
- Share your account credentials with others
- Use the Service for any illegal activities
5. Content Ownership
5.1 Your Content
You retain ownership of the captures you create using the Service. By using the Service, you grant us a limited license to store and process your captures solely to provide the Service to you.
5.2 Third-Party Content
The web pages you capture may contain content owned by third parties. You are responsible for ensuring you have the right to capture and use such content. We are not responsible for any third-party content captured through the Service.
6. Evidentiary Use
While AmberProof is designed to support legal and evidentiary purposes, we make no guarantees about the admissibility of captures in any legal proceeding. The admissibility and weight of evidence is determined by courts and legal authorities.
Each capture includes:
- Timestamp of capture
- SHA-256 cryptographic hash for integrity verification
- Original URL
- Screenshot and HTML preservation
7. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue the Service at any time with reasonable notice when possible.
8. Fees and Payment
Certain features of the Service may require payment. Current pricing and payment terms will be displayed at the time of purchase. All fees are non-refundable unless otherwise stated.
9. Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.
10. Intellectual Property
The Service, including its design, features, and content (excluding user captures), is owned by AmberProof and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMBERPROOF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
13. Indemnification
You agree to indemnify and hold harmless AmberProof and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
14. Termination
We may terminate or suspend your account at any time for violation of these Terms or for any other reason with notice. Upon termination, your right to use the Service will cease immediately. You may export your data before termination.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AmberProof operates, without regard to conflict of law principles.
16. Changes to Terms
We may modify these Terms at any time. We will notify users of material changes by posting a notice on the Service or by email. Continued use of the Service after changes constitutes acceptance of the modified Terms.
